BACKGROUND:
Pursuant to NRS 445B.275, the Air Pollution Control Hearing Board (Hearing Board) must consist of seven members who are not employees of the State or any political subdivision of the State. One member must be a licensed attorney, another must be a licensed professional engineer, and a third must be a general engineering contractor or general building contractor. The other four are lay member positions that do not require a professional license. The term of each appointment is three years. The positions are voluntary appointments with no compensation.
The terms of attorney member Ryan Dennett and lay members Donald Bordelove, Troy Hildreth, and Amy Lahav expire on October 16, 2026. The positions were advertised in the "Las Vegas Review-Journal" on June 7, 2026, and posted on the County website from June 7, 2026, through July 7, 2026. Additionally, one lay member position that has been vacant since July 2024 was posted on the County website as an open and continuous recruitment. The Department of Environment and Sustainability, Division of Air Quality received seven applications for the positions. Six were received for the lay member positions, including applications from Bordelove, Hildreth, and Lahav, who reapplied for their positions. Three additional applications were received from Ryan Talley, James Thomas, and Mary Wagner. Additionally, current attorney member Dennett reapplied for his position. Upon review of the applications and after conducting interviews, staff has determined that all seven applicants are qualified to be Hearing Board members.
Staff recommends the reappointment of Dennett as the attorney member, the reappointment of Bordelove, Hildreth, and Lahav as lay members, and the appointment of Talley, Thomas, or Wagner as the fourth lay member for three-year terms commencing on October 20, 2026, and ending on October 19, 2029.
