BACKGROUND: 

During the April 15, 2025, Board of Commissioners meeting comments were made regarding an ordinance that has been in development by staff that addresses the issue of granting telecommunication franchises to companies that only provide broadband services and provide no compensation to the County. With the adoption of Assembly Bill 509 (2025 Regular Session of the Nevada Legislature) local governments are granted the authority to enter into agreements with broadband providers allowing the broadband providers access to public rights-of-way with compensation paid to the local governments.  

The proposed ordinance provides for a franchise agreement for broadband providers and establishes a business license fee, and, in lieu of the fee, allows for in-kind services or goods to the County to expand and promote the installation of broadband services and/or broadband infrastructure access in designated areas within the County.   

Staff recommends that the ordinance to amend Title 5, Chapter 5.01 and Title 6, Chapter 6.13 of the Clark County Code be introduced and a public hearing be set for November 18, 2025, at 10 a.m.
