BACKGROUND:
Clark County participated in a U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) Consortium with the City of North Las Vegas, which used a portion of those funds to help repay a $4 million bond issued in 1998 for Windsor Park relocation. After the bond was fully repaid, $2.4 million in CDBG funds remained, totaling approximately $2.7 million with interest. In 2023, following the enactment of SB450, the City notified HUD of their intention to transfer the remaining funds to the Nevada Housing Division for a new Windsor Park project. With HUD’s direction, the County, City, and State established the Multi‑Jurisdictional Windsor Park Reconciliation Agreement to ensure the funds are used in compliance with SB450 and HUD‑authorized CDBG activities.
On May 19, 2026, the Board of County Commissioners approved the Multi‑Jurisdictional Windsor Park Reconciliation Agreement. Since the project involves federal HUD funding, Clark County must comply with the National Historic Preservation Act by completing a Section 106 review, which requires identifying historic properties, evaluating potential impacts, and addressing any harm. The State Historic Preservation Office (SHPO) serves as the County’s primary consulting partner in this process.
Given that Windsor Park likely contains historically significant structures, Clark County, the State, and SHPO developed a Programmatic Agreement (PA) to allow work to proceed efficiently while ensuring historic resources are appropriately considered. The PA creates a streamlined compliance framework for demolishing unsafe buildings, acknowledging both the neighborhood’s probable historic significance and the unavoidable adverse effects associated with demolition.
Under the PA, Clark County follows a tailored process for identifying and evaluating historic resources and documenting findings. When adverse effects occur, the County and State must prepare a public technical report and produce interpretive materials to preserve Windsor Park’s history. All documentation and professional work must meet federal standards.
This agenda item is to seek approval for the County Manager or his designee to execute the Programmatic Agreement on behalf of Clark County. Staff recommends approval.
The District Attorney's Office has reviewed and approved this item as to form.
