Approve and authorize the Director of Real Property Management or designee to sign the Second Amendment to Lease Agreement between Clark County (County) and Beltway Business Park Office No. 2, LLC (BBP Office 2) to decrease the size of the leased area by ±1.50 acres. The ±1.50 acres were added to the leased area with the First Amendment to Lease Agreement for supplementary parking. The parking is no longer needed by BBP Office 2 and the acreage will be integrated into a future lease take down. The ±1.50 acres are a portion of County-owned land known as Assessor's Parcel Number 176-01-601-023, generally located on the northwest corner of Badura Avenue and Edmond Street. BACKGROUND:
On August 21, 2001, the Board of County Commissioners (Board) approved a Lease Option Agreement between Clark County (County) and Beltway Business Park, L.L.C. (Beltway) for the development, construction, operation and sublease of commercial facilities on ±298 acres of County-owned land within the Cooperative Management Area. On January 18, 2005, the Board approved a Lease Agreement with Beltway Business Park Office No. 2, LLC (BBP Office 2) for ±8.09 acres known as Assessor's Parcel Number 176-01-601-021. On November 8, 2006, the Board approved the First Amendment to Lease to expand the leased area by ±1.50 acres for supplementary parking.
BBP Office 2 no longer needs the ±1.50 acres for parking, and Beltway wishes to integrate the acreage into the proposed lease take down for Beltway Business Park Warehouse No. 10, LLC (BBP Warehouse 10). The proposed lease takedown for BBP Warehouse 10 is a companion to this item on the agenda.
