BACKGROUND: 

Clark County has determined that a portion of the Flood Control Facility located within Assessor's Parcel Number 177-12-196-002 is a nuisance and a maintenance problem. Per Nevada Revised Statute 244.276, staff is requesting Board approval to adjust the Flood Control Facility and convey ± .12 acres to the abutting property owner, Topaz 5 LLC. Topaz 5 LLC is willing to accept the adjustment to the Flood Control Facility and conveyance.

The District Attorney's Office has reviewed and approved the resolution as to form.
