BACKGROUND: 

On May 23, 2023, the Board of County Commissioners (Board) approved the award of SOQ No. 606429-22 for Consulting Assessment and Abatement Monitoring Services for Asbestos, Mold, Lead Containing/Lead Based Paint and Indoor Air Quality to Nova Geotechnical and Inspection Services, LLC dba Universal Engineering Sciences (NBE) in the amount of $400,000 aggregate annually for professional services.

This Contract is for consulting assessment and abatement monitoring services for asbestos, mold, lead containing/lead based paint and indoor air quality services.

The following are the pertinent provisions of the Contract:
                     The term of the Contract was from date of award through June 30, 2024 and included the option to renew                      for 4, one-year periods and included a 3-month extension.
                     Included the County’s option to terminate for cause, convenience or default and suspend the Contract                      with advanced written notice.

On November 11, 2024, Clark County received notification from Nova Geotechnical and Inspection Services, LLC dba Universal Engineering Sciences stating their firm no longer has a local Certified Industrial Hygienist (CIH) or Certified Safety Professional (CSP) on staff at their local Las Vegas branch.

On December 17, 2024, Clark County sent an email notifying the firm to provide the name(s) and credential(s) of the replacement of CIH and CSP professional who are based in Clark County by January 2, 2025.

On January 21, 2025, Clark County issued a Cause and Corrective Action Notice requesting the firm to provide the name(s) and credential(s) of the replacement of CIH and CSP professional who are based in Clark County by close of business day on February 3, 2025.

On February 5, 2025, the Purchasing and Contracts Division issued a Notice of Intent to Terminate Contract for Cause and Notice of Meeting to Consider Administrative Action, by certified letter giving the minimum 21 working days’ notice. This letter stipulated that the Contract would be terminated effective March 18, 2025, and the firm will also be removed from the current qualified list subject to the Board's approval. Staff recommends that the Board terminate the Contract with Nova Geotechnical and Inspection Services, LLC dba Universal Engineering Sciences.

This action is in accordance with page 5, Section IX, Letter B, Termination for Cause.
