BACKGROUND:
On September 3, 2002, the Clark County Board of County Commissioners approved a revocable license and maintenance agreement between Clark County and Sam’s Town Hotel and Casino (Licensee) permitting Licensee to construct and maintain fences constructed by Licensee within the Monson Channel public right-of-way located along Flamingo Road, east of Nellis Boulevard, adjacent to Sam’s Town Hotel and Casino.
Licensee wishes to terminate the revocable license and maintenance agreement, and subject to the terms of the revocable license and maintenance agreement, Licensee shall, at its sole cost and expense, remove all existing nonstandard improvements from the Clark County right-of-way and replace them with County-standard improvements, consisting of expanded metal fencing and related appurtenances in accordance with Clark County standards and permits. Once this work is completed and Clark County has accepted the work, the revocable license and maintenance agreement will be terminated, and Clark County will assume ongoing maintenance of the County-standard improvements.
