BACKGROUND:

The Clark County Regional Flood Control District (RFCD) has programmed funds for the design and construction of flood control improvements. On April, 11, 2019, RFCD and Clark County entered into an interlocal contract for the Flamingo Wash between Maryland Parkway and Palos Verdes Street project. The Board of County Commissioners approved the interlocal contract on May 7, 2019.

RFCD and the County previously approved Supplemental Nos. 1 and 2 to the interlocal contract to reallocate funding, adding a line item for Entity Design labor, and increase total funds for design engineering, environmental and CLOMR/LOMR for the project.

The attached Supplemental No. 3 to the interlocal contract will increase funding to cover the costs of the design consultant supplemental contract for construction support services. The time of performance remains effective until June 30, 2024, unless time extensions are granted.

RFCD approved the third supplemental contract at its meeting on July 13, 2023.

The District Attorney's Office has reviewed and approved the third supplemental contract as to form.
