BACKGROUND: 

On January 18, 2022, the Board discussed conflicts in the County Code regarding drive-through window restrictions for certain businesses and directed staff to prepare an ordinance to address these conflicts and to add walk-up window service as an approved use for service of food only through the window. Title 8 of the Clark County Code prohibits certain restaurants that have a drive-through window from obtaining a liquor license, whereas supper clubs may have a liquor license and provide drive-through service for food only. The Code also prohibits certain liquor establishments from having a drive-through window for the service of food only. The provisions in Code governing drive-through windows do not include walk-up window service.     

Staff recommends that the Board of County Commissioners sitting as the Liquor and Gaming Licensing Board introduce the ordinance to amend Chapter 8.20 of the County Code and set a public hearing for February 15, 2022, at 10:00 a.m.
