BACKGROUND:
On December 20, 2016, the Board adopted the District Service Rules, codifying the various customer and regulatory resolutions dating back to 1956. The Service Rules provide a single document for customers to find the rules, rates, and charges for connecting to the publicly owned sewer system. Codifying the resolutions into a single document has benefited both customers and staff by presenting the Service Rules in a contemporary language and in an organized format.
The proposed amendments to the Service Rules include changes to Rates and Charges, including increased fees for septage/chemical toilet waste disposal, fat/oil/grease/grit (FOGG) interceptor inspections, and the capacity maintenance charge (formerly availability charge). Additionally, the amendments introduce new fees for point of connection (POC) processing, plan reviews, and construction inspections. They also allow for the use of Hydromechanical FOGG interceptors under certain limited circumstances and establish a corresponding application fee.
Additional key changes being proposed are administrative in nature and include updates and clarifying language regarding delinquent accounts and POCs for single family residences.
The proposed resolution was introduced to the Board on April 15, 2025, and a public hearing was set for May 20, 2025, at 10:00 a.m. A Business Impact Statement on the proposed resolution was accepted by the Board on May 6, 2025. Although no formal feedback was received in the process of preparing the Business Impact Statement, informal feedback was received from stakeholders requesting the fees be phased-in over a few years. As such, the District is advancing amendments to the original proposal that reduces some of the proposed fees and otherwise phases-in some of the fees over 2 or 3 years, in accordance with the Attachment 1 recommendations that have earned the support of stakeholders. Attachment 2 is the proposed summary of changes.
Notice of the public hearing was placed in the Las Vegas Review Journal on April 20, April 27, May 4, May 11, and May 18, 2025. The proposed resolution and amended Service Rules were also posted on the District website.
If adopted, Resolution 25-002 codifies these amendments to the District Service Rules effective on July1, 2025.
