BACKGROUND:
On March 21, 2024, the Nevada Supreme Court issued its decision in the Mountain Vista Holdings, LLC v. TransWest Express LLC case. The Nevada Supreme Court made several findings that impact the way eminent domain actions will proceed in the future. On April 22, 2024, TransWest Express LLC, the utility company that initiated the eminent domain action, filed a motion for reconsideration of the Nevada Supreme Court's decision.Ratification of the filing of an amicus brief in support of TransWest Express, LLC by the District Attorney's Office or its designee is being sought from the Board of County Commissioners.
