BACKGROUND: 

Clark County conducts its general purchasing efforts under authority and in conformance with NRS 332 (Purchasing: Local Governments). NRS 332 authorizes the Board of County Commissioners (the "Board") as the governing body to delegate certain functions to authorized representatives. The Board has historically provided this authority through resolution.

On September 21, 2004, the Board approved a resolution establishing the authority of the authorized representatives responsible for the development, award and proper administration of all purchases and contracts of a local government (the "Resolution"). The Resolution designated the Chief Financial Officer for the Purchasing and Contracts Division and the Director of Aviation as the Authorized Representatives enabling them to execute the purchasing functions as provided for under NRS Chapter 332.

On September 3, 2019, the Board approved an amendment to the Resolution to incorporate changes to the purchasing laws adopted during the 80th (2019) Legislature. The amended Resolution also provided for clarification of provisions consistent with NRS Chapter 332, and updates to the guidelines, which fall under the Clark County Fiscal Directives.

This amendment incorporates recent updates to the Clark County Fiscal Directives by amending the Resolution guidelines to better ensure Authorized Representatives are able to continue purchasing functions in a timely and efficient manner. 

Staff recommends that the Board approve, adopt and authorize the Chair to sign the amendment to the Resolution.
