BACKGROUND:
The District uses liquid oxygen to generate ozone used in the wastewater treatment process. By effectively controlling liquid oxygen production, the District can optimize the wastewater treatment process, maintaining a high standard of final treatment in compliance with environmental and safety regulations. This contract will provide for the supply of liquid oxygen, maintenance, inspections and repairs of the storage tanks and associated appurtenances.
Invitation to Bid (ITB) No. 260003, for the procurement of Liquid Oxygen, was advertised on July 22, 2025, in the Las Vegas Review Journal and posted on the District website. On August 27, 2025, two (2) firms responded by submitting bids. The bid results are as follows:

District staff has determined that the bid received from Linde Inc., was non-responsive because the bidder took exceptions to several terms and conditions stipulated within the ITB. Therefore, staff recommends that the bid be awarded to Airgas USA, LLC, as the lowest responsive and responsible bidder.
The following are the pertinent provisions of the contract:
• The initial term of the contract is from April 5, 2026 through April 4, 2027;
• The contract includes the option to renew for nine (9) additional one-year periods with an increase not to exceed 10% for each year of the contract term;
• This contract includes the District's option to terminate or suspend for cause or convenience with advance written notice.
In accordance with NRS 332.065, if the governing body or its authorized representative has advertised for or requested bids in letting a contract, the governing body or its authorized representative must award the contract to the lowest responsive and responsible bidder. Airgas USA, LLC currently holds a Clark County business license.
