BACKGROUND:
On May 1, 2007, the Board of County Commissioners (Board) approved the award of CBE No. 600642-07 for Dark Fiber Lease to American Fiber Systems dba Idacomm, Inc.(NBE) in the amount of $752,000 to provide a lease for dark fiber. On May 20, 2011, Purchasing approved the assignment of Contract from American Fiber Systems dba Idacomm, Inc., to Zayo Group, LLC (NBE).
The following are the pertinent provisions of the Contract:
• The term of the Contract was from May 1, 2007 through April 30, 2012.
• Included the County’s option to terminate for cause, convenience or default and suspend the Contract with advanced written notice.
Amendment No. 1 extended the contract term from May 1, 2012 through April 30, 2017 and included the option to renew for an additional 60-month period.
Amendment No. 2 changed the contract end date to June 20, 2017 and decreased the monthly cost beginning June 21, 2017 through June 20, 2022. It also included an additional one 60-month period beginning June 21, 2022 through June 20, 2027 with a 5% annual increase to the award amount.
Approval of Amendment No. 3 will provide for an additional 8 strands of Dark Fiber. The attached Amendment No. 3 document details the modifications and costs involved.
Zayo Group, LLC currently holds a Clark County Business License.
