BACKGROUND: 

NRS 4.150 authorizes the Clark County Board of Commissioners (Board) to appoint an individual to fill a vacancy that occurs in the office of justice of the peace.  NRS 245.170 establishes the process by which the Board may make such an appointment, requiring, when permitted, the appointment of a suitable person who is an elector of Clark County to serve the remainder of the unexpired term.  Pursuant to that statutory authority, on June 16, 2015, the Board adopted a resolution creating a Justice of the Peace Nominating Committee to recommend qualified nominees to the Board of County Commissioners for appointment to vacant justice of the peace offices.

Subsequently, the Board amended the resolution to allow the Board to waive the appointment of a Nominating Committee, or any procedures set forth in the resolution, when an incumbent Justice of the Peace vacates the department after the election of his or her successor, but prior to the start of the elected successor's term, in order to appoint the elected successor to fill the vacancy.

At the June 9, 2026, Nevada Primary Election, Sam Bateman was elected with one hundred percent of the vote to serve as Justice of the Peace, Henderson Township Department 2, with a term beginning January 4, 2027.

On June 23, 2026, Judge Stephen L. George submitted his letter of resignation from the office of Justice of the Peace, Henderson Township, Department 2, effective August 14, 2026.  Thus, a vacancy in the office will occur on August 15, 2026.

Therefore, because the incumbent Justice of the Peace is vacating his department prior to the expiration of his term, and because Sam Bateman has already been elected to serve as Judge George's successor, the Board may waive the requirements of the Resolution creating the Nominating Committee and appoint Sam Batement to fill the vacancy beginning on August 15, 2026, through the remainder of unexpired term.
