BACKGROUND:
Pursuant to NRS 445B.500(3), civil penalty money collected for violations of the Air Quality Regulations in excess of $17,500 must be transferred to the Clark County School District (CCSD). CCSD may spend air quality penalty money only in accordance with an annual spending plan approved by the Board of County Commissioners. NRS 445B.500(3) specifies that the annual plan shall be approved if the expenditures are reasonable and limited to programs of education on topics related to air quality and projects that improve air quality.
As of June 30, 2021, Clark County has $946,002.13 available to transfer for CCSD’s use.
The proposed expenditure of penalty funds for FY 2022 in the amount of $2,011,464.36 reflects both the $946,002.13 available for transfer and the $1,065,462.23 balance carried over from FY 2021. The proposed expenditure includes continuation of support for the Pollen Monitoring and Education Program conducted by CCSD and the University of Nevada, Las Vegas; continuation of support for the Las Vegas Science and Technology Festival; science and technology professional development for teachers and staff; development of units of instruction regarding clean air, ozone awareness, and health and safety issues related to air quality; acquisition of instructional materials that are aligned with the revised Nevada Academic Content Standards (NVACS) for Science; support of classroom instruction of units developed regarding clean air, ozone awareness, and health and safety issues related to air quality; and evaluation of the feasibility and implementation of air quality improvement projects within CCSD in partnership with the Clark County Department of Environment and Sustainability, including, but not limited to, bus fleet conversions, traffic management plans to reduce idling of school buses, and energy efficiency and air quality improvement projects throughout CCSD facilities.
Staff recommends acceptance of the FY 2021 summary report of air quality penalty funds, approval of the proposed expenditure for FY 2022, and transfer of the funds in the amount of $946,002.13.
