BACKGROUND:
Pursuant to NRS 237.080, a BIS was prepared for proposed new ordinances adding provisions protecting the facilities and services of the Clark County Water Reclamation District ("District").
Public notice was published daily in the Las Vegas Review-Journal from November 5 - 19, 2025. In addition, the District sent notification of the proposed ordinances to its Citizens Advisory Committee and stakeholders. The notification and proposed ordinances were also posted on the Publications section of the District's website.
The deadline to respond was November 26, 2025, giving respondents 22 days to comment on the proposed ordinances, during which the District received 59 comments. These comments expressed two concerns: (1) that language in the ordinances was wrongfully directed at septic tank users, and (2) professional surveyors needed a process to gain access to District-owned manholes. In response, the District has modified the original proposed language to remove specific references to septic users, and District staff commits to working with professional surveyors outside of the language of the ordinance to establish a process by which professional surveyors can gain approved access to District-owned manholes such that no violation of the proposed ordinance has occurred. The modifications to the original proposed language are included in the proposed ordinances being advanced to public hearing for approval.
Staff recommends that the Board accept and approve the BIS described above and determine that it does not impose a significant economic burden upon a business or directly restrict the formation, operation or expansion of a business.
