BACKGROUND: 

On July 21, 2020, the Board of County Commissioners approved and authorized the Chair to sign an interlocal agreement between Clark County and the Regional Transportation Commission of Southern Nevada (RTC) for the Maryland Parkway Bus Rapid Transit (BRT) project. As agreed upon in the interlocal agreement, RTC in conjunction with their consultant AtkinsRéalis have been assisting the County obtain the necessary rights-of-way for the aforementioned project.

AtkinsRéalis has been engaged in negotiations to acquire a portion of Assessor's Parcel Number 162-22-502-004 (ENP Nevada Inc) needed as right-of-way for construction of the BRT project; however, the negotiations have not resulted in reaching an agreement. In the event that continued negotiations are unsuccessful, authorization to initiate a condemnation action is being requested from the Board.

Nevada Revised Statute 241.034 and the Resolution of Clark County adopted on September 5, 2006, requires the County to serve the property owner with written notice informing the property owner that the County will be considering acquiring the property by eminent domain. Such notice was mailed in a timely manner prior to the submission of this item to the Board of County Commissioners.
