BACKGROUND: 

On June 04, 2024, the Board of County Commissioners approved and authorized the acquisition by negotiation a portion of Assessor's Parcel Number 176-22-801-003 (James Richard Choate and Diane De Mond), needed for construction of the Blue Diamond Railroad Channel; Blue Diamond Road to Rainbow Boulevard project. Clark County Department of Public Works staff has been engaged in negotiations; however, the negotiations have not resulted in reaching an agreement. In the event that continued negotiations are unsuccessful, authorization to initiate a condemnation action is being requested from the Board.

Nevada Revised Statute 241.034 and the Resolution of Clark County adopted on September 5, 2006, requires the County to serve the property owners with written notice informing the property owners that the County will be considering acquiring the property by eminent domain. Such notice was mailed in a timely manner prior to the submission of this item to the Board of County Commissioners.
