BACKGROUND:
Assembly Bill 68 passed at the 2017 Nevada Legislative Session (NRS 484B.313(5)(c)) allowing for advertising on touchdown structures which are defined as "a structure connected to a pedestrian bridge, which houses an elevator." The advertising can only be performed by the adjacent property owner who has granted a fee or perpetual easement to the public authority for the construction and maintenance of the touchdown structure and has entered into a written agreement with the public authority.
MGM Grand Hotel, LLC, New Castle, LLC (also known as Excalibur Hotel and Casino), New York-New York Hotel and Casino, LLC, and Park MGM LLC (collectively, "Owner"), which hold lease interests in property on the northwest, northeast and southwest corners of Las Vegas Boulevard and Tropicana Avenue adjacent to touchdown structures for the pedestrian bridges, has requested authorization from Clark County to advertise on those touchdown structures. There are six touchdown structures associated with these pedestrian bridges.
MGP Lessor, LLC, the successor owner in interest, granted a fee interest or perpetual easement to the County for the Touchdown Structures adjacent to the Excalibur Hotel and Casino, New York-New York Hotel and Casino, Park and MGM Grand Hotel, LLC, and transferred a lease interest to MGM Lessee, LLC, who conveyed a leasehold estate to the Owner except MGM Grand Hotel. MGM Grand Propco, LLC, the successor owner in interest, granted a fee or perpetual easement to the County for the Touchdown Structures adjacent to the MGM Grand Hotel and Casino and granted a lease interest to MGM Lessee II who transferred a leasehold estate to MGM Grand Hotel.
County staff from the District Attorney's Office and Public Works has negotiated a licensure agreement for advertising on touchdown structures with the Owner's representatives which provides for the terms and conditions for the advertising. The agreement, with a term of August 17, 2021 through August 17, 2026, includes the terms of advertising, payment provisions as well as indemnification. The Board of County Commissioners may extend the term of this agreement up to two years.
