BACKGROUND: 

In accordance with the Fort Mohave Valley Development Law, the Board of County Commissioners created the Fort Mohave Development Fund (2340) on August 7, 2007. Any money received by the County in connection with the administration of the Fort Mohave Valley Development Law must be deposited into the Fort Mohave Valley Development Fund and used only for purposes expressly authorized by the Fort Mohave Valley Development Law.

Upon approval of the First Amended and Restated Laughlin Landfill Agreement, Clark County will amend its franchise agreement with Republic Dumpco, Inc., governing the operation of the Laughlin Landfill located within the Fort Mohave Valley. The restated agreement requires Republic Dumpco to pay Clark County (1) a license fee, and (2) an additional fee equal to five percent (5%) of Gross Revenue derived from the disposal of out-of-state solid waste at the Laughlin Landfill (the "Fort Mohave Fee").

The proceeds from the Fort Mohave Fee are intended to be used for the benefit of the residents of Fort Mohave Valley but are not subject to any limitations on their expenditure by the Fort Mohave Valley Development Law. This item therefore requests to amend and restate the resolution which established the Special Revenue fund so that the unrestricted proceeds from the Fort Mohave Fee may be deposited and accounted for separately within a sub-fund in the Fort Mohave Valley Development Fund (2340).

The license fee will continue to be deposited in the General Fund
