BACKGROUND: 

The District currently uses a gas phase odor control scrubbing unit located at Spring Mountain Road and Industrial Road to reduce sewer odors on the Las Vegas Strip. Staff has determined the overall performance of conventional carbon media utilized within this odor control unit does not adequately address the system's odor suppression requirements. To alleviate the odor, staff tested the use of a Persnickity brand patented converter media, during a major repair a few years ago.  The test results far exceeded performance expectations. In addition to being more efficient, Persnickity brand patented converter media is more cost effective having to be replaced approximately once every six (6) months compared to the conventional carbon media that requires monthly replacement.

Staff confirmed that Persnickity brand odor control converter/polishing media is only available through its authorized sole source distributor, Syneco Systems Inc.

Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to Syneco Systems Inc., for Persnickity odor control converter/polishing media on an as needed basis. Staff will submit an annual report to the Board detailing incurred expenditures.

The following are pertinent provisions of the agreement:
                     The term of the agreement is from March 21, 2022 and will continue for as long as the competitive bidding exception applies, with a price increase not to exceed 10% for each year of the contract term;
                     The agreement includes the option to terminate or suspend for cause or convenience with advance written notice of intent.

In accordance with NRS 332.115.1(a), the competitive bidding process is not required because the product can only be purchased from a sole source distributor. Clark County business license has determined that Syneco Systems Inc. (LBE) does not require a business license or a business registration.
