BACKGROUND:

On November 5, 2002, the voters of Clark County approved Ballot Question No. 10, which provides the Regional Transportation Commission of Southern Nevada (RTC) with the financial capability to administer and operate the Las Vegas Freeway and Arterial System of Transportation (FAST) System.

On April 15, 2003, Clark County, RTC, City of Henderson (COH), City of Las Vegas (CLV), City of North Las Vegas (NLV), and the Nevada Department of Transportation (NDOT), {collectively Member Agencies} entered into Agreement No. NM 176-03-016 to combine the Las Vegas metropolitan area arterial traffic management system and the NDOT freeway management system into a single integrated organization referred to as FAST System.  Continuing the FAST System would be beneficial for the Member Agencies and the people of the State of Nevada.

On July 14, 2016, the Member Agencies terminated Agreement No. NM 176-03-016 and replaced with a new original FAST System agreement to combine the Las Vegas Metropolitan Area Arterial Traffic Management System (AMS) and the NDOT Freeway Management System (FMS) into a single integrated organization known as "FAST."

Between February and May 2020, a proposed amendment to the FAST Agreement (NDOT Agreement No. P392-18-016) was considered and approved to revise the funding source for the FAST AMS from Question 10 Sales Tax to Motor Vehicle Fuel Tax funds.

The attached Amendment No. 1 to the Agreement will continue the FAST System, which is a benefit to the Member Agencies, and revises the funding formula to Motor Vehicle Fuel Tax funds generated within the County.

RTC approved the amended agreement at its meeting on June 10, 2021.  The remaining Member Agencies are scheduled to approve the amended agreement at their respective Board and Council meetings.

The District Attorney's Office has reviewed and approved the amended agreement as to form.
