BACKGROUND:

On January 6, 2021, the Board of County Commissioners considered a waiver of development standards application, WS-20-0507, submitted by Matter UnCommons LLC and Matter Durango LLC (together as "Owner") concerning property (Assessor's Parcel No. 176-04-201-009) located on the southeast corner of Durango Drive and the Clark County 215 Beltway within Spring Valley.  Specifically, the waiver application requested permission to place a freestanding sign within a drainage channel easement that runs parallel to Durango Drive.  The Board approved the waiver of development standards application subject to a condition that required the Owner to enter into an agreement acceptable to the County indemnifying, defending, and holding the County harmless for the removal, replacement or relocation of the sign.

The attached Indemnity, Defense & Hold Harmless Agreement with the Owner fulfills the condition attached to the approval of the waiver of development standards application approved in WS-20-0507 to allow a freestanding sign on and over the drainage easement.

The Owner does not currently hold a Clark County Business License.

County staff approves of this waiver.

The District Attorney's Office has reviewed and approved the agreement as to form.
