BACKGROUND: 

Pursuant to NRS 445B.275, the Air Pollution Control (APC) Hearing Board must consist of seven members who are not employees of the State or any political subdivision of the State. One member must be a licensed attorney, another must be a licensed professional engineer, and a third must be a licensed general engineering or building contractor. One opening is for a licensed general engineering or building contractor, and the other is for the lay member position (which does not require a professional license). The term of each appointment is three years. The positions are voluntary appointments with no compensation.

The terms of APC Hearing Board contractor member Daniel Sanders and lay member Elspeth Cordua expired on September 17, 2021. The positions were advertised in the Las Vegas Review-Journal on Sunday, May 30, 2021, and posted on the County's website from June 1, 2021, through July 1, 2021. The Department of Environment and Sustainability, Division of Air Quality (DAQ) received three applications for the positions. Two applications were received for the lay member position: one from Cordua, who reapplied for her position, and one from Susan Gracia. Additionally, current contractor member Sanders reapplied for his position. Upon review of the applications and after conducting interviews, staff has determined that all three applicants are qualified to be APC Hearing Board members.

Staff recommends the reappointment of Sanders as the contractor member and the reappointment of Cordua as the lay member for three-year terms commencing on September 21, 2021, and continuing through September 20, 2024.
