BACKGROUND:
On October 6, 2020, the Board of County Commissioners approved and authorized the acquisition by negotiation of portions of Assessor's Parcel Numbers 177-18-401-001 (Zheng Da, LLC, a Nevada Limited Liability Company) and 176-13-501-023 and 176-13-501-024 (The UTE Indian Tribe) needed for the improvements to Decatur Boulevard between Cactus Avenue and Warm Springs Road. On April 20, 2021, the Board approved and authorized the acquisition by negotiation of a portion of Assessor's Parcel Number 140-21-101-005 (Cynterra Corp) needed for the improvements to Carey Avenue between Nellis Boulevard and Toiyabe Street. County Public Works staff has been engaged in negotiations; however, the negotiations have not resulted in consummating the acquisitions. In the event that continued negotiations are unsuccessful, authorization to initiate condemnation actions is being requested from the Board.
Nevada Revised Statute 241.034 and the Resolution of Clark County adopted on September 5, 2006, require the County to serve the property owners with written notice informing the property owners that the County will consider acquiring the properties by eminent domain. Such notices were mailed in a timely manner prior to the submission of this item to the Board.
