BACKGROUND: 

The District Attorney's Office has received information and evidence that the property located at 7040 Quarry Rd in Clark County, Nevada is being used for an auto repair business without zoning, business license, building code, fire code and health code permits and approvals. The use of 7040 Quarry Rd includes repairing customer vehicles at the property, parking customer vehicles in front of the property and throughout the neighborhood, operating a business at the property and other uses not permitted in the R-2 zoning district. The owner of the property is Andrew Oglesby. Mr. Oglesby has refused to stop operating the auto repair business even after receiving several administrative citations and liens being placed on the property. Therefore, the District Attorney's Office seeks authorization to commence an action in Clark County District Court by whatever remedy the District Attorney's Office deems necessary to end the illegal use of the property in question and to bring the property and its operators of the uses into compliance with all laws, rules and regulations that apply. This request includes authorization for the District Attorney's Office to collect unpaid taxes and fees and to seek reimbursement of attorney's fees and costs incurred during the handling of the action.

The District Attorney's Office recommends that the Board of County Commissioners authorize such action.
