BACKGROUND: 

BPS Harmon, LLC, a Delaware limited liability company ("Grantor"), is granting a pedestrian access easement for the BPS Development generally located at 3717 Las Vegas Boulevard (Assessor's Parcel Number 162-21-214-005).  The Grantor desires to grant to Clark County a permanent easement for the operation, use, maintenance, construction, reconstruction, repair, and modification of sidewalks and related appurtenances, along with the right of public pedestrian access, passage, ingress and egress on, over, under, and through Grantor's property.

This pedestrian access easement is being required as a condition of approval on VS-20-0271 and will only record if the vacation records.  The vacation is for portions of Las Vegas Boulevard and Harmon Avenue.

The attached agreement and grant of easement for pedestrian access grants a permanent easement to the County and describes additional terms and conditions as they relate to both the County and the Grantor.

The District Attorney's Office has reviewed and approved the agreement and grant of easement for pedestrian access as to form.
