BACKGROUND:
During a special meeting on May 18, 2015, in response to public attention given to compliance in guardianship cases, Clark County BCC approved creating a full-time Guardianship Compliance Administrator. On July 1, 2017, by way of Senate Bill 433, NRS 247.305 was amended by allocating $1.00 of every recording fee collected for the exclusive use of the District Court to pay the compensation of minor guardianship investigators. In May of 2018, a state-wide guardianship commission submitted to the Nevada Supreme Court a list of proposed court rules relating to guardianship, and the rules contemplate utilizing investigators in the compliance process. On September 4, 2018, the Board of County Commissioners approved and authorized the creation of three (3) permanent Guardianship Compliance Investigator positions (I27/I28) for the Eighth Judicial District Court.
The District Court now seeks to add a fourth investigator, as a limited permanent position, in order to address the dramatic decrease in minor guardianship case compliance, Rule 10 investigations, and performing various functions, including reviewing accountings filed by guardians and responding to allegations or claims affecting proposed protected persons.
