BACKGROUND:

NRS 331.187 allows the State of Nevada to charge counties for liability and defense costs incurred in defending lawsuits and claims arising from District Court employees' activities, excluding the activities of judges. The District Court Judges are State elected officers and are covered by the State liability system. Under NRS 331.187, the counties may elect to pay an assessment per employee of the District Court; hold the State harmless and assume all liability and costs of defense for the employees of the District Court; or reimburse the State for any liability and costs of defense that the State incurs for the employees of the District Court. Pursuant to the statute, Clark County has previously elected to pay an assessment per employee.

The fiscal year 2022 assessment is $85.40 per employee. The County has 708 District Court employees, resulting in a total fiscal year 2022 assessment of $60,463.20.
