BACKGROUND: 

The District's Flamingo Water Resource Center treatment facility utilizes an Ultraviolet (UV) Light Disinfection System manufactured and distributed by Trojan Technologies Group, ULC. The District uses this system for final disinfection of effluent to meet its discharge standards. To ensure uninterrupted plant treatment operations and maintain critical processes, the District must have a readily available source of parts and services to replace, maintain, and support continuous operation of this equipment, which includes, but is not limited to, specialized UV lamps and various system components.

Staff confirmed that Trojan UV lamps, specialized parts, equipment, repair, and technical support are only available through its authorized sole source distributor, Trojan Technologies Group, ULC.

Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to Trojan Technologies Group, ULC for Trojan UV lamps, specialized parts, and services on an as needed basis, for as long as the competitive bidding exception applies. Staff will submit an annual report to the Board detailing incurred expenditures.

The following are pertinent provisions of the agreement:
                     The term of the agreement is from the date of award and will continue for as long as the competitive bidding exception applies, with a price increase not to exceed 10% for each year of the contract term;
                     The agreement includes the option to terminate or suspend for cause or convenience with advance written notice of intent.

In accordance with NRS 332.115.1 (a) & (d), the competitive bidding process is not required because the parts, equipment, and services can only be purchased from a sole source distributor, and the equipment is compatible with existing equipment. Trojan Technologies Group, ULC, (LBE) currently holds a Clark County business license.
