BACKGROUND: 

The District’s treatment facilities utilize equipment manufactured and distributed by Evoqua Water Technologies, LLC.  The District uses this equipment for wastewater processes at its primary and secondary clarifiers including dissolved air flotation (DAF) thickeners. To ensure uninterrupted plant treatment operations and maintain critical processes, the District must have a readily available source of parts and services to replace, maintain, and support continuous operation of this equipment, which includes, but is not limited to, clarifier drives and various clarifier mechanisms.

Staff confirmed that Evoqua products and services are only available through Evoqua Water Technologies, LLC.

Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to Evoqua Water Technologies, LLC, for Evoqua products and services on an as needed basis, for as long as the competitive bidding exception applies. Staff will submit an annual report to the Board detailing incurred expenditures.

The following are pertinent provisions of the agreement:
                     The term of the agreement is from December 1, 2021 and will continue for as long as the competitive                      bidding exception applies, with a price increase not to exceed 10% for each year of the contract term;
                     The agreement includes the option to terminate or suspend for cause or convenience with advance written                      notice of intent.

In accordance with NRS 332.115.1 (a) & (d), the competitive bidding process is not required because the parts and services can only be purchased from a sole source distributor. Evoqua Water Technologies, LLC, (LBE) currently holds a Clark County business license.
