BACKGROUND: 

NRS 245.040 permits the Board of County Commissioners to authorize a county officer to rent, equip and operate, at public expense, one or more branch offices in the county. Presently, Clark County Code 2.28.040 allows the county clerk, at the clerk’s discretion, to locate branch offices in the city of Mesquite, the city of Henderson, and the town of Laughlin, to provide those services and perform such duties as the clerk determines will best serve the public in these locations. The County Clerk currently operates branch offices in the city of Henderson and the town of Laughlin.

The County Clerk wishes to enter into an interlocal agreement with the city of Mesquite to open and maintain a branch office in the Mesquite City Hall, with the days and hours of operation to be determined by the County Clerk upon the approval of the interlocal agreement. In accordance with NRS 277.045(1), the parties are authorized to enter into cooperative agreements to perform any governmental functions, including the furnishing or exchange of property or facilities of any kind. 

Additionally,  pursuant to NRS 122.040(1)(a), a board of county commissioners in a county whose population is 700,000 or more may, at the request of the county clerk, designate not more than five branch offices of the county clerk at which marriage licenses may be issued, if the designated branch offices are located outside of the county seat.  Concurrently with the approval of the interlocal agreement, the County Clerk requests that the Board designate and authorize the Mesquite branch office to issue marriage licenses.

Clark County District Attorney's Office has reviewed and approved the attached agreement.
