BACKGROUND: 

The Board of County Commissioners adopted the "Clark County Ozone Redesignation Request and Maintenance Plan" for the 1997 ozone (O3) National Ambient Air Quality Standard (NAAQS) in March 2011 (2011 Maintenance Plan). On January 8, 2013, the U.S. Environmental Protection Agency (EPA) found Clark County had attained the ozone standard, issuing final approval of the 2011 Maintenance Plan and redesignating the nonattainment area to attainment for the 1997 O3 NAAQS, effective February 7, 2013. The 2011 Maintenance Plan demonstrated Clark County’s attainment status and identified the control measures in place to ensure the standard was maintained through 2022.

Under Section 175A of the Clean Air Act, Clark County is required to submit a plan demonstrating attainment of the 1997 O3 standard for a second 10-year period following the expiration of the initial maintenance period. The attached plan serves as the second 10-year maintenance plan for the Clark County 1997 O3 standard maintenance area. Its purpose is to demonstrate how the area continues to attain the 1997 O3 NAAQS and will remain in attainment of the standard during the second maintenance period (through 2033).

The proposed plan was made available for public comment from October 14 through November 15, 2021. A public hearing on December 21, 2021, will provide the public with an additional opportunity to provide comments prior to the Board of County Commissioners' consideration of the plan.
