BACKGROUND:
On November 15, 2021, the Department of Administrative Services approved the award of Bid No. 605941-21; for Annual Requirements Contract for Janitorial Services at Stephanie Street Campus to Jani Crew Las Vegas, LLC (WBE).
This Contract is for janitorial services at Stephanie Street Campus.
The following are the pertinent provisions of the Contract:
• The term of the Contract was from date of award through August 31, 2022 and included the option to renew for 4, one-year periods.
• Included the option to increase the award amount up to 10% based on possible increased user requirements for the renewal terms and approved budget appropriations.
• Included the option to increase the award amount up to 3% for possible price increases for renewal terms.
• Included the County’s option to terminate for cause, convenience or default and suspend the Contract with advanced written notice.
On February 1, 2022, the Department of Administrative Services, issued a Cause and Corrective Action Notice for failure to provide staff capable of clear communication in the English language on site at all times during service hours and providing qualified individuals who were able to pass a SCOPE and NCIC background check.
On March 8, 2022, the Purchasing and Contracts Division received an email from Jani Crew Las Vegas, LLC stating that its current employee would be leaving their employment as of March 8, 2022. Clark County responded with an email dated March 8, 2022, offering to open discussion regarding the possibility of Jani Crew Las Vegas, LLC providing another employee who could pass SCOPE and NCIC background check to resume services on March 9, 2022. Jani Crew Las Vegas, LLC was not able to provide an acceptable substitute.
For safety reasons, Clark County must be able to communicate clearly and successfully with Jani Crew Las Vegas, LLC's staff onsite. In addition, any interpreters brought onsite for this purpose, must be covered by Jani Crew Las Vegas, LLC's Workman's Compensation insurance and badged in accordance with the Contract.
On March 9, 2022, the Purchasing and Contracts Division issued a Notice of Intent to Terminate Contract for Cause and Notice of Meeting to Consider Administrative Action, by certified letter giving the minimum 21 working days’ notice. This letter stipulated the Contract would be terminated effective April 19, 2022, subject to the Board's approval. Staff recommends that the Board terminate the Contract with Jani Crew Las Vegas, LLC.
This action is in accordance with General Conditions Section, Page II-5, Item No. 34, Termination for Cause.
