BACKGROUND: 

Clark County's "Las Vegas Boulevard Roadway Improvements from Spring Mountain Road to Sahara Avenue" project includes installation of some proposed bollards adjacent to property (Assessor's Parcel No. 162-09-502-001) owned by LV-PCPS LLC, LV-AM LLC, and LV-MRPC LLC (the "Sahara Entities").  During the installation of bollards fronting the Sahara Entities property, Sahara Entities discovered the bollard installations would impact its existing onsite irrigation waterline.

The attached mutual compromise, settlement and release agreement will compensate Sahara Entities $232,326.00 which includes the fair market value for the easement for the bollards, waterline removal costs and temporary construction easements necessary for the County's project.  This agreement settles all claims related to the County's project, the easement and the waterline, and constitutes a waiver and release of said claims.

The District Attorney's Office has reviewed and approved this contract as to form.
