BACKGROUND: 

The District Attorney's Office has received information and evidence that the property located at 905 and 955 E Twain Ave. in Clark County, Nevada is being used for an unlawful and unsafe apartment house without a business license and in violation of the public nuisance law and other laws. The use of 905 and 955 E Twain Ave. includes uninhabitable and unlicensed apartment houses and transient lodging. The owner of the property is Apex Las Vegas, LLC. Apex Las Vegas, LLC and its individual and corporate owners and others in control of the Property have refused to stop operating or improve the unsafe apartment house business even after METRO and Code Enforcement started making monthly visits to address high amounts of crime and abate dangerous conditions on the Property. In the past year there have been 694 calls for service at this Property, including 3 homicides, 18 shootings, a SWAT search of an open drug house and 50 burglary or robberies. Therefore, the District Attorney's Office seeks authorization to commence an action in Eighth Judicial District Court by whatever remedy and cause of action the District Attorney's Office deems necessary to end the illegal use of the property in question and to bring the property and its operators of the uses into compliance with all laws, rules and regulations that apply. This request includes authorization for the District Attorney's Office to collect unpaid taxes, damages and fees and to seek reimbursement of attorney's fees and costs incurred during the handling of the action.

The District Attorney's Office recommends that the Board of County Commissioners authorize such action.
