BACKGROUND: 

Clark County (County) and the City of Henderson (City) have negotiated this Interlocal Agreement (Agreement) to establish a compatible land use planning area (Planning Area) around Henderson Executive Airport (Airport) to achieve the common goals of limiting new and increased densities of residential uses to ensure the long-term viability of the Airport and prioritize corporate attraction. The pertinent provisions of this Agreement are as follows:

     •    Term is for 10 years with two (2) automatic renewal periods of five (5) years.
     •    City and County shall not approve, or propose, amendments or updates to their land use plans that would
           permit residential uses on properties that do not have existing residential entitlements within the     
           Planning Area.
     •    City and County shall not approve land use applications for properties within the Planning Area with
           existing residential entitlements that would exceed the maximum number of residential units permitted by
           the existing zoning or comprehensive plan designation. 
     •    City and County will use commercially reasonable efforts to encourage non-residential development and
           re-development on property within the Planning Area.

This Agreement was accepted and approved by the City at its City Council meeting on April 5, 2022.

This Agreement has been reviewed and approved as to form by the District Attorney's Office.
