BACKGROUND: 

Clark County, through its Department of Public Works, is designing and constructing roadway improvements in Desert Inn Road between Nellis Boulevard and Blue Ash Lane (Public Works Project No. PW.R054G16).  The Las Vegas Valley Water District (LVVWD) desires to install a water pipeline and appurtenances in conjunction with the County's project.  Per LVVWD's petition, the County is willing to perform the construction and construction management of the water facilities so long as LVVWD pays for all costs and expenses associated with the construction and construction management of the water facilities.

Within 30 calendar days after the final design plans of the water facilities are completed, LVVWD will pay to the County the full amount of the estimated water facilities design cost; and the County will assign all rights, title, and interest to the water facilities construction plans to LVVWD.

The attached Interlocal Agreement No. 140295-A provides for the responsibilities of the County and LVVWD, and also describes the terms and conditions as they relate to the County and LVVWD.  The water facilities installed under this agreement will remain the exclusive property of LVVWD and will become a part of the general water distribution system.  Upon completion of the project, the water facilities will be maintained by LVVWD.

The District Attorney's Office has reviewed and approved the interlocal agreement as to form.
