BACKGROUND:
This Contract is for software, software maintenance, cloud services, hardware and a variety of services to multiple County departments with Oracle America, Inc. (LBE).
A Fiscal Directive No. 6, Competitive Bidding Exception, was approved because Oracle supports the Information Technology operations for all County departments. This includes Kronos, Elections databases, Social Services Case Management Systems (ACES), Fleet Management, Unity Replication Systems, Assessor databases, and Family TRACS 2.0.
The following are the pertinent provisions of the Contract:
• The term of the Contract is from the effective date through June 1, 2023 and includes the option to renew for 4, one-year periods.
• Non-Discrimination/Public Funds language has been modified from the Clark County's standard Non Discrimination/Public Funds languauge.
• Includes the County’s option to terminate for cause, convenience or default and suspend the Contract with advanced written notice.
The recommendation of award is in accordance with NRS 332.115.1(b), the competitive bidding process is not required as the services to be performed are professional in nature, NRS 332.115.1(g), the competitive bidding process is not required as the item to be purchased pertains to hardware and associated peripheral equipment and devices for computers and NRS 332.115.1(h), the competitive bidding process is not required as the item to be purchased pertains to software for computers.
Non-Discrimination/Public Funds language in the master contract is not consistent with Clark County's standard Non-Discrimination/public Funds language.
Oracle America, Inc. currently holds a Clark County Business License.
