BACKGROUND: 

On August 3, 2021, the Board approved the One Nevada Agreement, which outlines the distribution of recovered opioid proceeds from the opioid litigation, including attorney's fees. On January 18, 2022, the Board approved Amendment 1 which reduced the attorney fees for the local governments from 25% to 15% based on a federal court order in the multijurisdictional opioid litigation. Amendment 1 only applies to the opioid recoveries from the settlements with AmericourceBergen Drug Corporation, Cardinal Health, McKesson and Janseen/Johnson & Johnson.

This Amendment 2 revises Section B paragraph 3 of the One Nevada Agreement to clarify how the State of Nevada will distribute the recovery payments from the opioid litigation. The payments will be calculated based on the percentages agreed to in the original Agreement minus the applicable attorney fees per each local government's contingency fee or in the case of the distributors and Janseen/Johnson & Johnson settlements fifteen (15%) based on the federal court order in the multijurisdictional litigation.
