BACKGROUND: 

The District utilizes Simplex Grinnell security and fire alarm equipment throughout its facilities to help detect security and/or fire breaches. To meet code compliance, the alarming devices require inspections, testing, repairs, modifications, additions, and smoke control recertification services. To ensure uninterrupted District operations and maintain critical safety processes, the District must have a readily available source of equipment, parts and services.

Staff confirmed that Simplex Grinnell security and fire protection alarm inspections, equipment, maintenance, and monitoring, is only available through Johnson Controls Fire Protection LP (JCFP), the authorized sole source distributor and services provider of Simplex Grinnell security and fire equipment.

Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to JCFP for security and fire protection alarm inspections, testing, repairs, modifications, alarm monitoring and related goods and services on an as needed basis. Staff will submit an annual report to the Board detailing incurred expenditures.

The following are pertinent provisions of the agreement:
• The term of the agreement is from August 1, 2022 and will continue for as long as the competitive bidding exception applies, with a price increase not to exceed 10% for each year of the contract term;
• The agreement includes the option to terminate or suspend for cause or convenience with advance written notice
of intent.

In accordance with NRS 332.115.1 (a), the competitive bidding process is not required because the product can only be purchased from the sole source distributor. Johnson Controls Fire Protection LP (LBE) currently holds a Clark County business license.
