BACKGROUND: 

Richard Gallagher is the owner if the property located at 3530 S. Pecos Road, Las Vegas, Nevada ("Property"). Code Enforcement found Mr. Gallagher in violation of Clark County Code Title 30.44.010(b)(7) and 1.14.030 and issued an administrative citation and civil penalty against Mr. Gallagher.  Mr. Gallagher appealed code Enforcement's decision to District Court and the parties have agreed to resolve Mr. Gallagher's code enforcement case as follows: 1) within 30 days Mr. Gallagher will pay $26,070; 2) agrees to not engage in any transient lodging activity unless Mr. Gallagher holds a valid Clark County business license that permits transient lodging at the Property and 3) dismiss the case against Clark County. Clark County agrees to accept $26,070 as payment for the violations of Title 30.44.010(b)(7) and 1.14.030.

The District Attorney's Office recommends that the Board of County Commissioners approve the settlement agreement and authorize the Director of Administrative Services to sign the settlement agreement.
