BACKGROUND: 

SHAC LLC, d/b/a Sapphire, a licensed Adult Entertainment Cabaret located at 3025 Sammy Davis Jr. Drive, applied for a Class A Slot Machine License on July 22, 2021, for the installation of 12 bar-top poker machines. 

Pursuant to CCC 8.04.070, the Board may deny an application for a gaming license if the place or location for which the license is sought is unsuitable for the conduct of gaming. Any place located within a 250-foot radius of an adult-oriented business is presumed to be unsuitable for the conduct of gaming unless the Board determines, after a public hearing, that the public health, safety, and welfare will not be impaired by granting the application. SHAC LLC, d/b/a Sapphire, is an adult-oriented business.

Staff recommends that the Board conduct a public hearing regarding the application submitted by SHAC LLC, for a Class A Slot Machine License and thereafter determine whether the location for which the license is sought is suitable for the conduct of gaming.
