The initial Contract amount was $320,956, Amendment No. 1 decreased the Contract amount by $10,432.20, Amendment No. 2 increased the Contract amount by $8,537,186, Amendment No. 3 increased the Contract amount by $8,480,000, Amendment No. 4 increased the Contract amount by $60,300, Amendment No. 5 increased the Contract amount by $79,330, Amendment No. 6 increased the Contract amount by $42,335 and Amendment No. 7 will increase the Contract amount by $861,400.   The amount of perpetual licensing fees is $6,247,871.90, for a new Contract amount of $24,618,946.70.14 should the County continue to use the software through May 31, 2025.

 

BACKGROUND: 

On January 5, 2019, the Board of County Commissioners (Board) approved the award of CBE No. 603915-15 to Dominion Voting Systems, Inc. (LBE) in the amount of $320,956 to provide voting systems software and equipment.

The following are the pertinent provisions of the Contract:
                     The term of the Contract was from September 1, 2015 through August 31, 2016. Amendment No. 2                      extended the contract through May 31, 2020 and included the option to renew for one-year periods as                      along as the County uses the system.
                     Included the option to increase the award amount up to 25% based on possible increased user                      requirements for the renewal terms and approved budget appropriations.
                     Included the County’s option to terminate for cause, convenience or default and suspend the Contract                      with advanced written notice.

Amendment No. 1 ratified the effective date of the Contract to September 1, 2015 and included a $10,432 credit for Win EDS license fees covering September 1, 2015 through December 31, 2015.

Amendment No. 2 provided for the purchase of new voting machines and software.  Additionally, it extended the term of the Contract through May 31, 2020 with the ability to renew for one-year periods as long as the County uses the equipment and system.

Amendment No. 3 provided for the purchase of additional new voting machines, printers, licensing and software fees.

Amendment No. 4 provided for a new module that will allow Clark County Nevada citizens to vote over seas.  This approval also allowed for the option to increase the award amount up to 25% based on possible user requirement for the renewal terms and for the correction of the contract total to include annual fees that would be needed for as long as the department uses the voting system.

Amendment No. 5 provided mail ballot readers hardware and software licenses for the upcoming primary election.

Amendment No. 6 provided absentee/vote by mail hardware and polling location hardware.

Approval of Amendment No. 7 will provide equipment to replace the previous mail ballot readers to a high-speed reader/scanner to meet the high volume of mail ballots.

Dominion Voting Systems, Inc. currently holds a Clark County Business License.
