BACKGROUND: 

Clark County, through its Department of Public Works, is constructing a project known as "Paradise Road between Harmon Avenue and Sands Avenue - Phase 3B" (Project No. PW.S013201).  The Las Vegas Valley Water District (LVVWD) desires to replace a water pipeline and appurtenances in conjunction with the County's project.  Per LVVWD's petition, the County is willing to perform the construction and construction management of the proposed water facilities contingent upon all costs and expenses associated with the construction of the water facilities are paid by LVVWD.

Within 30 calendar days following award of the construction contract by the Board of County Commissioners, LVVWD will pay to the County the full amount of the estimated water facilities costs, and LVVWD will obtain all rights, title, and interest to the water facilities.

The attached Interlocal Agreement No. 115416-A provides for the responsibilities of the County and LVVWD, and also describes terms and conditions as they relate to the County and LVVWD.  The water facilities installed under this agreement will be and remain the exclusive property of LVVWD and will become a part of the general water distribution system.  Upon completion and acceptance of the project, LVVWD will be responsible for maintaining the water facilities.

The District Attorney's Office has reviewed and approved the interlocal agreement as to form.
