BACKGROUND:
Pursuant to NRS 445B.500 and Clark County Code Section 9.08.120, the Board of County Commissioners appoints independent hearing officers to determine violations and levy administrative penalties under Chapter 445B of the Nevada Revised Statutes and the Clark County Air Quality Regulations. Clark County Code Sections 2.68.020 and 9.08.120 require that hearing officers: (1) be residents of the state of Nevada, (2) be graduates of an accredited law school or an accredited four-year college, (3) have at least five years' experience in public administration, (4) not be employees of the state of Nevada or any of its political subdivisions, and (5) have a working knowledge of air quality issues, arbitration, law and/or engineering. The term of each appointment is two years.
The Department of Environment and Sustainability, Division of Air Quality (DAQ) is seeking one hearing officer. DAQ received an application from Holly Fic seeking appointment to the position (copy attached). Upon review of the application and after conducting an interview, DAQ staff recommends the appointment of Holly Fic based on her qualifications and experience with decision making, air quality regulations, engineering, law, public administration, and administrative boards. As required by Clark County Code Section 2.68.020(A)(3), new appointees will complete a four-hour course in administrative law provided by the District Attorney's Office before hearing any cases.
