BACKGROUND:
On January 17, 2023, the Board of County Commissioners (Board) approved the award of CBE No. 606480-22 to Las Vegas Valley Water District in the amount of $197,858 for providing a water commitment on a conditional basis only for a regional park special event area, located on the east side of Durango Drive, north of Flamingo Road.
This Agreement provides for a water commitment on a conditional basis only for a regional park special event area, located on the east side of Durango Drive, north of Flamingo Road with Las Vegas Valley Water District.
The following are the pertinent provisions of the Agreement:
• The term of the Agreement will begin upon Las Vegas Valley Water (DISTRICT) approval of the plans.
• This Agreement shall terminate, and the conditional commitment shall be void if any of the following occurs:
• Construction of the water facilities covered by the plan or plans identified in Article I, paragraph D of this Agreement is not diligently commenced within 1 year from the date of DISTRICT approval of said plan or plans; or
• If active construction work is discontinued for a period of 1 year, or if such construction is commenced within said 1 year period, but is not diligently prosecuted to completion in a manner acceptable to the
DISTRICT.
This approval will provide for additional fees for the application for connection.
The recommendation of award is in accordance with NRS 227.180, the parties are authorized to enter into interlocal contracts to perform governmental functions and activities.
