BACKGROUND:

The Clark County Regional Flood Control District (RFCD) has programmed funds to design and construct flood improvements. On February 10, 2011, the RFCD approved an interlocal contract for design, right-of-way, and environmental mitigation for the Windmill Wash Detention Basin Expansion project. The Board of County Commissioners approved the contract on March 1, 2011.

RFCD and the County previously approved five supplementals to the interlocal contract that increased funds for design, right-of-way and environmental mitigation; changed the scope; added a line item for an Emergency Action Plan; extended the contract term due to ongoing coordination regarding environmental assessment and mitigation measures to acquire the Bureau of Land Management grant required for the project; changed the project name from "Windmill Wash Detention Basin Expansion" to "Windmill Wash Detention Basin Expansion and Jess Waite Levee Facilities"; and extended the time of performance to June 30, 2026.

The attached Supplemental No. 6 to the interlocal contract increases funds and adds a line item for entity design labor. The time of performance remains effective to June 30, 2026, unless time extensions are granted.

RFCD approved the sixth supplemental contract at its meeting on April 13, 2023.

The District Attorney's Office has reviewed and approved the sixth supplemental contract as to form.
