BACKGROUND: 

The District has an ongoing need for communication solutions including data circuits, telephone, and internet services to support its business and facilities operations, and maintain connectivity with the Clark County Government Center facilities. The District is currently receiving these services from Cox Communications Las Vegas, Inc. and Cox Nevada Telcom, LLC collectively Cox Business. The services include data internet services that allow staff to access and utilize data transfer capabilities, such as accessing websites, web hosting, and downloading files facilitated by internet infrastructure and service providers. The services also include data transport services for transferring data between locations across the network. Staff would like to continue to utilize these services from Cox Business based on the service area availability.

The following are pertinent provisions of the agreement:
• The agreement includes the option to terminate or suspend for cause or convenience with advance written notice of intent;
• The term of the agreement is from the date of the award, and will continue for as long as the competitive bidding exception applies.

In accordance with NRS 332.115.1 (c), (d) and (s), the competitive bidding process is not required because the services include additions to and repairs and maintenance of equipment which may be more efficiently added to, repaired or maintained by a certain person, the equipment purchased is compatible with existing equipment and include the design of, and equipment and services associated with, systems of communication. Cox Business currently holds a business license. Cox Business is a Neveda Business Enterprise (NBE).

Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to Cox Business for the procurement of Data Circuits and Data Transport Services for as long as the competitive bidding exception applies. Staff will submit an annual report to the Board detailing incurred expenditures.
